Terms of Service

These Terms of Service (“Terms”) govern your use of the Vocalized mobile app and related services at vocalized.space (together, the “Service”), operated by ASKIFY, 61 rue de Lyon, 75012 Paris, France (SIRET 105 109 649 00019) (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.

1. The Service

Vocalized is a mobile app for:

• Voice cloning — train a personal voice model from a live recording or imported audio sample
• Directed text-to-speech — generate speech with performance tags, refinement controls, and optional AI script assistance
• Catalog voices — use public voices from the Fish Audio catalog for text-to-speech (you do not own these models)
• Video Avatar (paid plans only) — create lip-synced talking-head videos from a photo plus an audio track

Generated speech and video files are saved on your device. The Service requires an internet connection for cloning, generation, account features, and purchases.

2. Accounts

• You must provide a valid email address and password to create an account.
• You must confirm your email before training a voice clone.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Do not share your account or attempt to bypass authentication, rate limits, or usage controls.

3. Acceptable use

You agree not to use the Service to:

• Clone, synthesize, or depict a voice or likeness without the legal right to do so
• Impersonate others, commit fraud, harass, defame, or create illegal or harmful content
• Generate content that violates applicable law or third-party rights (including copyright and publicity rights)
• Reverse engineer, scrape, or abuse the Service or its providers
• Resell, sublicense, or redistribute access to the Service without our written permission

Before training a clone or generating a Video Avatar, you must confirm that you have the right to use the submitted voice, likeness, and audio. We may suspend or terminate accounts that violate these rules.

4. Characters, billing & refunds

Usage is metered in characters (based on text length for speech, and on audio duration for Video Avatar).

Free tier

• New accounts receive 7,500 characters (~5 minutes of directed speech).
• Training a voice clone on the free tier costs 5,000 characters from your balance when training succeeds.
• AI script assistance is included and is not billed separately.

Paid character packs

• Additional characters are sold as one-time packs (Creator and Pro) via Stripe Checkout on vocalized.space/buy.
• Purchases are processed on the web, not through Apple or Google in-app purchase.
• After any paid purchase, voice clone training does not deduct characters (subject to daily fair-use limits).

Video Avatar (paid plans only)

• Available only after you purchase a character pack.
• Character cost is calculated from audio duration before generation starts (up to 90 seconds per video).
• If rendering fails on our provider’s side before completion, characters are refunded. After a video renders successfully, the charge is non-refundable, including if you do not download the file before it expires.

General billing terms

• Character balances have no cash value, are non-transferable, and do not expire while your account remains active unless stated otherwise at purchase.
• All sales are final except where required by applicable law or where we explicitly refund failed generations.
• We may change pack sizes, prices, or free-tier allowances with reasonable notice on vocalized.space.

5. Voice models & portability

• Voice models are trained and hosted under our platform Fish Audio account. They are linked to your Vocalized account in our database.
• Clones are created as public models on Fish Audio unless we offer a private option in the future.
• You may delete your clones in the app; we remove associated Fish models and account records when deletion succeeds.
• Model export is not offered. You may use clones inside Vocalized and delete them, but you cannot download or transfer trained model files to another service in the current version of the Service.

6. Your content

You retain ownership of content you submit (recordings, scripts, photos, and generated outputs). You grant us the rights necessary to operate the Service — including processing your content with our infrastructure and third-party providers (Fish Audio, OpenAI, HeyGen, Supabase) solely to provide the features you request.

We do not claim ownership of your generated speech or videos.

7. Third-party services

The Service relies on third-party providers, including Fish Audio (voice cloning and TTS), OpenAI (script assistance), HeyGen (Video Avatar rendering), Stripe (payments), Resend (email), and Supabase (auth and backend). Your use of the Service is also subject to those providers’ acceptable-use requirements where applicable.

8. Rate limits & availability

We apply fair-use rate limits (for example, daily caps on generations, clones, and AI assists) to protect the platform and control costs. The Service is provided on an “as available” basis; we do not guarantee uninterrupted access or specific output quality.

9. Termination

• You may delete your account at any time in Settings.
• We may suspend or terminate access for violation of these Terms, abuse, non-payment disputes, or legal requirements.
• On termination, your character balance and server-side voice models are removed as described in our Privacy Policy. Files already saved on your device remain until you delete them or uninstall the app.

10. Disclaimers

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. AI-generated speech and video may be inaccurate or unsuitable for your purpose. You are solely responsible for reviewing outputs before publishing or relying on them.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months before the claim, or USD $50 if you have not made a purchase.

12. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use after changes means you accept the revised Terms.
